 Abstract 

TThe article presents an analysis of criminal law and criminological aspects of article 106 of the Criminal Code of the Russian Federation. It is based on the provisions of international documents, as well as the Constitution of the Russian Federation. Personality is the main value of the Russian. This is confirmed, among other things, by the hierarchy of criminal acts in criminal legislation, as the murder of a newborn child by the mother art. 106 of the Criminal Code) is an offence against the person. The importance of the life of a child (including a newborn) is also shown at the level of international law. The composition of the relevant criminal act is expressed in the fact that the biological mother deliberately causes death to her newborn child during or immediately after childbirth, as well as in a psycho traumatic situation or in a state of mental disorder that does not exclude immutability. This article analyses the composition of the said criminal act. Attention is drawn to the characteristic of a woman who is prosecuted under article 106 of the Criminal Code of the Russian Federation. As a summary, the article shows the importance (theoretical and practical) of the content of the elements of the crime, as in practice it is possible to improve the methodology of detection of such crimes and separation from related compositions, and in theory - to improve criminal legislation.
